This policy, together with our Terms of Use and any other underlying agreements or terms, sets out the basis on which any data we collect from you, or that you provide to us, will be processed. By using this website you consent to the practices described in this policy. We may update this policy from time to time; we will notify you of changes by posting the updated policy on this page, and changes take effect when posted.

Website privacy notice

Kode-1 complies with Australian privacy legislation, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By accessing this site you acknowledge that you have read and understood this policy. We collect information to deliver personalised and relevant information about our services.

Information we collect

We may collect and process the following information:

  • Traffic and usage data — IP addresses, access dates and times, pages viewed, and approximate location data collected when you browse the site.
  • Information you submit directly — through forms on this site, by telephone, email, video conference, or post.

  • Sensitive information — including health information, only where you are applying for a position with Kode-1 and it is relevant to our assessment of whether you are able to perform the inherent requirements of the role.
  • Event participation — information you provide when registering for or attending trade shows, conferences, and webinars.
  • Service enquiries — your first and last name, email, location, organisation, and phone number when you enquire about our services.
  • Communications — information contained in any interaction you have with us.
  • Information from other sources — from representatives of your organisation, information providers, publicly available records, and social media.

By submitting your phone number, you agree that a representative of Kode-1 may contact you, potentially using automated technology (including texts and SMS messaging) or a pre-recorded message, at the number you provide.

How we use cookies

Security

We hold personal information in secure databases accessible only to authorised users, and invest in server, database, backup, and firewall technologies. We use third-party storage providers and cloud encryption, and some data may reside outside Australia. See our Security page for more detail. Transmission of information via the internet is not completely secure; any transmission is at your own risk.

Disclosing your information

We may disclose your personal information to:

  • affiliated business entities and related bodies corporate;
  • third parties who administer products or services on our behalf;
  • recipients in connection with a business merger, acquisition, or sale of assets;
  • law enforcement, in response to a valid subpoena, order, search warrant, or other lawful request; and
  • professional advisers such as auditors, accountants, and lawyers.

Third parties who receive personal information from us are required to keep it confidential and use it only for the limited purposes for which it was disclosed. We do not sell your personal information to third parties.

Overseas disclosure

We may disclose personal information to recipients located overseas, including in Canada, China, Colombia, France, Germany, India, Israel, Malaysia, the Netherlands, the Philippines, the United Kingdom, and the United States. Before disclosing personal information to an overseas recipient, we take steps reasonable in the circumstances to ensure the recipient complies with the APPs or is bound by a substantially similar privacy scheme, unless you consent to the overseas disclosure or it is otherwise required or permitted by law. Retention of your data

We retain personal information to fulfil the purposes for which it was collected, to meet our legal obligations in line with our retention policy, and to support our legitimate business interests. We take reasonable steps to destroy or de-identify personal information when it is no longer required, unless the law requires us to retain it.

Third-party websites

This site may link to third-party websites, whose terms and privacy policies are their own. We do not accept any responsibility or liability for their policies whatsoever, as we have no control over them.

Users of legal age

This site is intended for users aged 18 and over. No one under the age of 13 is authorised to submit or post any information, including personally identifying information, on this site, and parents or guardians may not agree to these terms on behalf of children under 13.

Accessing and correcting your information

You have the right to request access to, and correction of, the personal information we hold about you, to the extent required or authorised by the Privacy Act. We may ask you to verify your identity and to make your request reasonably specific, and we may charge a reasonable administration fee for access requests. We aim to respond within 30 days.

Complaints

Privacy complaints should be directed to our Data Protection Officer and will be treated seriously, dealt with promptly and in a confidential manner, and will not affect any existing obligations or commercial arrangements between you and Kode-1. If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC).
